DUI DWI Defense Attorneys

Often we hear two terms related to driving and intoxication: DWI and DUI. For the most part, in Texas, these terms are synonymous in use. DWI often means driving while intoxicated with alcohol being the cause of the intoxication. DUI often means driving while under the influence of some drug or chemical substance. In Texas, one legal statute criminalizes both terms by referring to intoxication as being caused by alcohol, by a drug, or by a combination of drugs and alcohol. However, you should be aware that DUI is sometimes used by local municipalities and justice courts to refer to a minor (a person under 21) who is under the influence of alcohol but who may not be intoxicated.

In any event, you will need an experienced lawyer who is trained in defending DWI and DUI cases. The Houston DWI defense attorneys at Musick & Musick LLP strive to achieve the greatest possible results for their clients. Our DWI defense lawyers attend specialized continuing education classes which focus upon the methodology and "science" behind impairment cases. (We use the term "science" loosely as there is very little scientific about the breath test machine or the field sobriety tests that are used in Texas.)

With so little science, you might ask how so many people are prosecuted for driving while intoxicated. Our clients typically have just left dinner where they had only a couple of glasses of wine. It might be they were entertaining a client or maybe they just left a club. The State will have officers watching for cars leaving from popular night spots and they almost always find the signs they need in order to stop the driver and start the DWI process rolling. Law enforcement agencies have what are commonly called DWI Task Forces. These officers have extensive training and experience related to finding people who might be intoxicated. These officers also receive a considerable amount of training on how to testify against defendants charged with DWI. Prosecutors are also very experienced in trying DWI cases since there are so many citizens charged with this crime. With officers and prosecutors trained to convict, you need an experienced DWI defense attorney on your side to fight for your rights.

It is not against the law to drink and then drive; however, MADD and other local and national organizations regularly make TV commercials and other media statements boldly claiming, "DRINK, DRIVE & GO TO JAIL". These types of statements misconstrue the law and only meant to poison the jury against those charged with driving while intoxicated.

If you are charged with Driving While Intoxicated, you better obtain a lawyer who knows and understands the laws and defenses relating to the crime, a lawyer that is experienced in going to trial in criminal court, and someone who will fight for all your rights. The Houston DWI defense attorneys at Musick & Musick, LLP have the knowledge and experience that you need for your fight. If you are successfully prosecuted the State will make you pay a surcharge to keep your driving privileges. It is important that you find the right DWI defense attorney.

It is also important to contact and employ an attorney quickly, as you only have fifteen (15) days from your date of notice of license suspension (usually the arrest date) to contest the suspension of your license; otherwise, you will automatically lose your privilege to drive. (See below for more details on license suspensions.) Make sure the DWI defense attorney you hire will also fight to keep your license.
